Wine Club - Terms & Conditions
To join the Anvers Wine Club (‘Wine Club’) or to shop via our online store you must be 18 years of age or over and be a resident of Australia. Anvers may request identification such as a driver’s license to confirm age. It is an offence under the Liquor Licensing Act 1997 (SA) to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18. Upon joining the Wine Club, you acknowledge and allow Anvers Wines Pty Ltd to charge your nominated credit card to complete your recurring Subscription orders. Member shipments are for personal consumption only and are not to be used for retail sale; Anvers reserves the right to disqualify any individual who is in any way interfering with the operations of the Wine Club.
MEMBERSHIP REQUIREMENTS
As a Member of the Wine Club, you are required to purchase a minimum of 12 bottles per annum which entitles you to receive discounts, invitations, limited free delivery and all other members benefits.
All communications regarding members accounts and orders are done so via email. It is the members’ responsibility to check junk folders.
PAYMENTS
Credit card payments are processed securely through third party payment processors (Shopify) and are subject to the terms and conditions of the respective processor. Those terms and conditions can be seen here: https://www.shopify.com/legal/terms
When choosing to pay via subscription, you are accepting to pay on a recurring basis and acknowledge an automatic payment will be made from your credit card based on the terms set out in your subscription. Subsequent payments made at the nominated frequency until you cancel your subscription.
Reminder emails are sent both 30 days and 7 days (ordinary days) before your subscription payment is due. Members are emailed notification of all failed process attempts and follow up emails to rectify the failed allocation.
Anvers accepts no responsibility for changes made to a member’s account by the account holder and any other persons who may have access to that account. Requests to update any member details must be made in writing to info@anvers.com.au unless otherwise arranged with Anvers.
It is the member’s responsibility to update their subscription delivery details on their online member account or by contacting wineclub@anvers.com.au. Any additional delivery charges or fees that are incurred due to an incorrect Member address will be the responsibility of the member (i.e. any charges associated with the recovery and/or re-direction of wines delivered to an incorrect or former address of the member).
You may cancel your membership once your 12-bottle commitment has been fulfilled by emailing wineclub@anvers.com.au with your name. Please also kindly include a reason for cancellation. If you wish to cancel your subscription prior to reaching your minimum commitment, Anvers reserves the right to charge a cancellation fee of $50 to your nominated credit card. If your personal circumstances mean that you are unable to honour your commitment, please contact Anvers Cellar Door directly.
PRIVACY POLICY
Anvers has a commitment to privacy in accordance with the Privacy Act 1988 (Cth), and the guidelines and policies of the Australian Privacy Commissioner. Anvers will retain member credit card details in a secure environment according to our Privacy Policy. Anvers will only use personal information for purposes to which the information is relevant, such as Wine Club essential communication. Anvers will never sell or share personal information with third parties, except to delivery partners within the purpose of the Wine Club and members may also opt-out of receiving communications from Anvers at any time.
By joining the Wine Club, Members consent to the use of their personal details for marketing purposes including to receive news, promotional offers, and other updates in relation to Anvers by mail, email, phone call, or text message.
DELIVERIES
Anvers uses third party couriers to dispatch our wines.
Once your online order is made, please allow up to five business days for your order to be packed and collected by our couriers. Delivery may take up to two weeks to be received depending on its destination. Anvers will endeavour to ensure all orders are received in a timely manner, however this is not always possible due to locality, weather, peak times, and extenuating circumstances for delivery companies.
Quoted delivery times are given as an approximate only and to the extent permitted by law. Anvers will not be liable to a member for failure to supply or deliver wines if surrounding circumstances are out of Anvers’ control.
Anvers is not responsible for any missing or damaged products after delivery has taken place.
Persons under the age of 18 cannot sign or accept delivery of wine.
Member Free Shipping is available for Subscription and additional orders within Australia only and excludes rural and remote areas.
HOT WEATHER POLICIES
Anvers reserves the right to hold/delay shipments during periods when there is extremely hot weather forecasted to ensure the quality of your wine is not compromised. Anvers endeavours to ensure the prompt delivery of your purchase when we deem the forecasted weather is suitable for transportation.
Please note that all Anvers wines are stored in fully climate-controlled facilities and Anvers does not cover or accept any responsibility for hot weather transport damage.
PRODUCT ISSUES
If any wine obtained through the Wine Club is faulty, notice must be given in writing to wineclub@anvers.com.au with an explanation within 48 hours of delivery. Anvers will replace or refund damaged wine if deemed reasonable and fair.
Anvers reserves the right to not exchange/replace or refund damaged or opened wines after delivery. Any heat damage due to wine being left outside after delivery, or improper storage will not be accepted by Anvers as we cannot control the weather and it is up to the customer to be responsible for their deliveries and storage. Anvers reserves the right to refuse requests to exchange and refund wine after it has been delivered.
If any Museum wine obtained through the Wine Club or Cellar Door is faulty, notice must be given in writing to wineclub@anvers.com.au with an explanation within 24 hours of the bottle being opened, and the wine re-sealed and returned to Cellar Door for appraisal within 48 hours. Anvers will replace or refund damaged wine if deemed reasonable and fair. Any heat, moisture, or visible cork damage due to wine being stored improperly will not be accepted by Anvers as customers are to be responsible for their wine deliveries and storage.
Anvers reserves the right to not exchange/replace or refund damaged or opened wines if deemed unreasonable.
